Acknowledgment and Assumption of Risk
and General Release
(Please Read This Release In Full Before Signing)
I
am aware that my participation in outdoor adventure activities such as
backpacking, rock climbing, kayaking and canoeing exposes me to many
potential risks, including the potential for severe injury or death. These hazards included, but are not limited to:
· Outdoor adventure activities take place in a natural environment, where
unexpected, unforeseen, and unmarked objects and conditions create risk of injury or
death from falling, tripping, slipping, insect or animal contact, unstable surface conditions,
falling rocks and objects, potentially harmful vegetation, and fire.
· Activities
near or in the water such as backpacking, canoeing, kayaking, rafting,
swimming, and wading involve the risk of falling, capsizing, or
otherwise losing control in cold water or water containing current
and/or other natural or manmade hazards that may result in injury
illness or drowning.
· Earth Water Rock: Outdoor Adventures Ltd. (hereafter: OUTDOOR ADVENTURES)
staff and guides use their best judgment in determining how to react to
circumstances such as weather, terrain, and water conditions. OUTDOOR ADVENTURES staff and guides may misjudge such circumstances, and individual’s capabilities, and the like.
· Weather conditions may change rapidly and unpredictably, and may cause injury
directly (e.g. rain or hail storms, sunburn, lightening strikes, wind, cold or hot
temperatures) or indirectly (e.g. impairing the performance of equipment).
· Equipment used in outdoor adventure activities may break, fail, or malfunction
despite reasonable maintenance and use. Some of the equipment used in outdoor
adventure activities may inflict injury even when used as intended. Persons may lose
control of their equipment and cause injury to themselves and/or others.
· Remoteness may enhance the hazards presented by engaging in outdoor
adventure activities due to the difficulty in communicating with emergency facilities and/or
personnel and the lack of easy access to medical facilities.
These are some of, but not all, the risks inherent in outdoor adventure activities. A complete listing of inherent and other risks is not possible. There are also risks that cannot be anticipated. I
agree to assume these risks and accept full responsibility for the
risks identified herein and those inherent risks not specifically
identified. My participation is purely voluntary
and I elect to participate in spite of and with full knowledge of the
risks. I, by initialing the line at the end of this sentence, expressly
acknowledge that I have read and understood this paragraph. ______

I
understand that I may be required to use or wear certain safety
equipment appropriate to my chosen activity, which shall be provided and
explained to me. (For example, an approved climbing helmet, or a coast guard approved lifejacket.) It is my responsibility to use the equipment as instructed, and to ask for clarification if I am unsure of the specifics of this responsibility.
I
agree and understand that all use of Outdoor Adventures facilities,
equipment, and services, and any transportation provided by Outdoor
Adventures, shall be undertaken by me at my sole risk and Outdoor
Adventures its owners, members, managers, employees, staff, guides,
contractors, volunteers, agents, and all other persons or entities
associated with that business (hereinafter collectively referred to as
“OUTDOOR ADVENTURES”) shall not be liable for any damages, harm, or
injuries, of any kind, nature or description to me or be subject to any
action, claim, demand or suit whatsoever for injury or damages,
including, without limitation those resulting from acts of active or
passive negligence on the part of OUTDOOR ADVENTURES. I,
for myself and on behalf my executors, administrators, heirs, assigns
and successors release OUTDOOR ADVENTURES from all such actions, claims,
demands, or suits. I, by initialing the line at the end of this
sentence, expressly acknowledge that I have read and understood this

I
acknowledge that I have entered into a contract the terms of which
release OUTDOOR ADVENTURES from any liability for personal injury or
property damage resulting from my participation in outdoor adventure
activities with OUTDOOR ADVENTURES, whether or not any injury and/or
damage results from OUTDOOR ADVENTURES’s negligence. I, by initialing
the line at the end of this sentence, expressly acknowledge that I have
read and understood this paragraph. ____ (Initial here)
I
authorize and release to OUTDOOR ADVENTURES the use of my image in any
photograph or video recording for any purpose of OUTDOOR ADVENTURES.

I
hereby give permission for transportation to any medical facility or
hospital and I authorize for any qualified guide or medical personnel to
render necessary emergency medical care for my family or myself.
In
consideration of, and as part payment for, the right to participate
with and utilize the services of Outdoor Adventures, I have and hereby
do assume all of the above-mentioned risks and will hold harmless
OUTDOOR ADVENTURES from all claims demands, and liabilities whatsoever,
both in law and equity, which may arise out of or in connection with
such activity.
